OBLIGATIONS OF THE PARTIES AND WARRANTY

  1. General provisions
    1. These conditions (hereinafter the Terms) apply to the legal relationship between the client (hereinafter the Buyer) of the kompik.ee online store (hereinafter kompik.ee) and the owner of kompik.ee, the firm Kompik Eesti OÜ (hereinafter Seller), with buying goods in kompik.ee.     5. Legal relations arising from the purchase of goods in the online store kompik.ee are regulated, in addition to these Terms, by legal acts in force in the territory of the Republic of Estonia.
    6. The consumer has the right to apply to the Consumer Disputes Committee of the Consumer Protection Board. The Committee on Consumer Disputes is authorized to resolve disputes arising from the contract between the consumer and the enterprise, which the parties could not resolve by agreement.   2. Customer data and data protection
    1. Personal data provided by the Buyer to the Seller is processed in accordance with the Data Protection Act. Data may be transferred to third parties only with the consent of the Buyer or in cases provided by law.
    2. The buyer is responsible for ensuring that his registration data (email address and password) are not known to third parties. Seller is not responsible for the consequences of getting the registration data of the Buyer in the hands of third parties through the fault of the Buyer.
    3. The buyer is responsible for the accuracy of the data provided to them. Seller is not responsible for the consequences of providing inaccurate data by the Buyer.
    4. The buyer undertakes to update his personal data on the website kompik.ee, if the data provided during registration are no longer valid. Seller is not responsible for the consequences arising from the obsolescence or inaccuracy of the data provided by the Buyer.
    5. In the case of an attempt by the Buyer to sabotage or disrupt the activities of the online store kompik.ee by their actions or inaction, or otherwise have a negative impact on it, the Seller has the right immediately and without warning to restrict or stop the client’s access to the site and refuse to continue serving it.
  3. Availability of goods, price and accuracy of information
    1. Seller is not taxable

    3. Order processing fee - Seller reserves the right to apply any additional fee indicated at the final stage of placing an order when placing an order. Starting the ordering, please note whether the order processing fee for a specific order of goods has been added.
    4. If the price of the product has become unreasonably low due to a system error, then Kompik Eesti OÜ is not obliged to sell the product, and the buyer will be refunded the amount.
    5. Goods may be in a foreign warehouse. Please note yes delivery time. After the checkout, claims are not accepted.
  4. Checkout
    1. The buyer can make an order in the online store kompik.ee through the order system on the website kompik.ee, writing to the email address info@kompik.ee or via Skype, Viber, WhatsApp (and other details in the section "Contacts" of the website kompik.ee)
    2. Placing an order does not imply an automatic reservation of goods. After placing the order, the Seller’s representative will contact the Buyer to confirm the order and agree on the details.
    3. If the execution of the order becomes impossible, the representative of the Seller has the right to offer the Buyer the opportunity to choose an equivalent product. If the Buyer does not request the replacement of the goods, the order will be canceled, and if he has already been paid, the Seller will refund the money to the Buyer’s account within a reasonable period of time from which the transfer was received.
  5. Conclusion of an agreement
    1. The Purchase and Sale Agreement between the Buyer and the Seller is concluded from the moment when the Buyer has made the first payment for the goods to the Seller’s bank account or in cash, to the authorized representative of the Seller.
  6. Order cancellation
    1. The buyer has the right to cancel an erroneous order, notifying the Seller by email, phone or other channels.
    2. The order will be automatically canceled if the Buyer has not made the first payment within two business days after the date of payment.
  7. Payment of goods
    1. The buyer has the right to make an advance payment for the purchase of 30% of the amount. In this case, the Buyer will receive the goods at the Seller’s client center when he pays the balance amount.
    2. The buyer has the opportunity to choose one of the existing payment methods to pay for the purchase: bank transfer to the Seller’s bank account, cash payment, Kompik Eesti OÜ payment card at the point of payment, installment plan.
    3. If the Buyer has not made the first payment for the Goods within the period specified in clause 6.2 of these Terms, the Seller has the right to cancel the order without notifying the Buyer thereof.
  8. Leasing
    1. The buyer has the opportunity to apply for leasing, that is, by installments to pay for purchases.
    2. The seller mediates the leasing services of its partners. The Seller submits to the partner the application and additional documents of the Buyer, and also notifies the Buyer about the decision made by the partner. The seller does not comment and does not justify the negative decisions made by the partner.
  9. Delivery of goods
    1. The Buyer has the right to receive the goods in the seller’s client center after the Buyer receives a notification from the Seller’s representative about the arrival of the goods in the client center.
    2. At the request of the client, the goods are delivered to the Buyer by courier or parcel machine. In this case, the cost of delivery will be added to the price of the goods according to the price list presented on the website kompik.ee.
    3. The seller is not responsible for any delay in delivery of the goods and for the resulting damage.
    4. The buyer must notify the seller of the non-conformity of the goods in the first days after he learned of the non-conformity of the goods.
  10. Refusal to purchase.
    1. The seller agrees to consider the option to terminate the contract of sale within 14 days from the date of purchase.
    2. Returns are only unused goods. The product must be in the original packaging, it must be preserved all the factory labels. Packaging can only be opened if it would be impossible to get acquainted with the goods otherwise.
    3. The right of refusal does not apply to goods made to suit the buyer's personal characteristics or special needs; audio and video recordings with open packaging and / or product activation; perishable or outdated goods; items in sealed packaging that are not suitable for return on loss of presentation or hygiene when the package is opened after delivery (for example, cosmetics, headphones, underwear and bikinis).
    4. If the Buyer wishes to terminate the contract of sale, he shall immediately notify the Seller of his wish by e-mail info@kompik.ee, attaching a photo of the goods or packaging to the letter. Seller reserves the right to require additional photos of the goods to be returned.
    5. The Buyer agrees to bear the costs associated with returning the goods, except in cases where the goods delivered to the Buyer do not correspond to those ordered.
    6. In case of termination of the contract, the goods should be immediately returned to the Seller.
    7. In the case of return of the goods, the Seller provides the Buyer the opportunity to exchange the goods for another product with a recalculation of the price.
    8. If the Buyer does not wish to exchange the goods, the Seller undertakes to transfer back the amount paid for the goods to the Buyer's current account within 14 days. Return of money is carried out only to the current account from which the Buyer made payment for the goods.
    9. The Buyer accepts the possibility that in case of abuse of the right to terminate the contract of sale, the Seller has the right to refuse to serve the Buyer.

Conditions for claims

  1. For new products purchased at kompik.ee, the time for submitting claims is up to 24 months for a part of the person. For legal entities according to the manufacturer's warranty period.
  2. At the time of filing a complaint, the Consumer has the right to repair or replace the product for free. In the event of a malfunction from the manufacturer, all defects, both materials and work, will be covered.
  3. Claims are accepted only on the basis of the document of purchase.
  4. Warranty obligations do not include instructions on product use, setting up, maintenance, cleaning, restoring the presentation or eliminating defects caused by non-compliance with instructions for use.
  5. Claims for damage caused during transportation after delivery to the buyer are not accepted.
  6. Kompik Eesti OÜ does not accept the following list of defects or situations for warranty reviews:
    1. software bugs installed in the device.
    2. normal wear.
    3. Incorrect use or maintenance (including when the device was repaired or serviced by someone not authorized by the manufacturer).
    4. Damage, replacement, or deletion of the serial number of a device and / or component, a control sticker, or a label with a marking.
    5. Defects that Kompik Eesti OÜ notified the customer before purchasing the product.
    6. External factors. External factors include lightning, improper electrical voltage and voltage fluctuations, humidity, fluid, mechanical damage, etc.
    7. The product does not work due to owner error, misuse, failure to follow operating instructions or due to improper storage, maintenance, or product overload.
  7. In determining responsibility, Kompik Eesti OÜ relies on expertise (diagnostics) performed by an authorized representative of the manufacturer. If, as a result of the inspection, defects related to the factors listed above can be repaired, the Consumer has the opportunity to order a paid repair.
  8. Examination (diagnostics) of the equipment is paid by the Consumer, if Kompik Eesti OÜ is not responsible for the elimination of the defect found in the equipment and the repair of the equipment is impossible. The consumer must also pay the cost of the examination, if as a result of the examination (diagnostics) the malfunction or defect is not installed and the device meets the manufacturer’s specifications.
  9. If a consumer does not agree with the position of Kompik Eesti OÜ, he must prove that:
    1. Is a defect (based on expert judgment).
    2. The defect or cause existed at the time of delivery of the device and was not known about them.
    3. Kompik Eesti OÜ is responsible for the deficiency.

Maintenance / repair time is 7-30 days. Maintenance / repair time for foreign warranty partners is 30-70 days.
